Welcome to HouseOfIcons (the “Site” or “Services”). These Terms and Conditions (“Terms”) form a legally binding agreement between you (“you,” “your,” or “Model”) and HouseOfIcons (“we,” “us,” or “our”) regarding your use of the website located at Iconiccast.com.

By accessing the Site or using our Services, you agree to comply with and be bound by these Terms. If you do not agree, do not use this Site.

1. Description of Services

HouseOfIcons provides an online platform that enables aspiring models and talent to create professional profiles and showcase their portfolios to potential clients, brands, and casting directors. We are a modeling platform; we are not a modeling agency. We do not guarantee employment, bookings, or representation by any specific agency.

2. Eligibility and Account Registration

  • Age: You must be at least 18 years old to create an account independently.

  • Minors: If you are between 13 and 17 years old, you may only use the Site through an account registered by your parent or legal guardian, who must agree to these Terms on your behalf. We do not accept registration from persons under 13.

  • Accuracy: You agree to provide true, accurate, current, and complete information during registration and to maintain the accuracy of this information. You are responsible for maintaining the confidentiality of your account credentials.

3. Model Profiles and Content

A. Your Content License to Us

When you upload photographs, videos, biographies, or other content (“Model Content”) to your profile, you grant HouseOfIcons a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, display, reproduce, distribute, and modify that content solely for the purpose of operating, promoting, and providing the Services (e.g., displaying your book to clients). This license does not grant us the right to sell your images commercially for our own profit.

B. Content Representations

You represent and warrant that:

  • You own the Model Content or have the necessary rights and permissions to upload and license it to us.

  • The content does not infringe upon the intellectual property rights, privacy rights, or publicity rights of any third party.

  • The content is not obscene, pornographic, defamatory, unlawful, or otherwise inappropriate.

C. Content Monitoring

We have the right, but not the obligation, to review, remove, or edit Model Content at our sole discretion if we believe it violates these Terms.

4. Prohibited Conduct

You agree that you will not use the Site to:

  • Violate any federal, state, or local laws.

  • Impersonate any person or entity or provide false information.

  • Engage in harassment, bullying, or abusive behavior toward other users or HouseOfIcons staff.

  • Attempt to interfere with the proper working of the Site, including uploading viruses or malware.

  • Scrape or crawl the Site to collect information about other models or clients.

5. Fees and Payments (If Applicable)

  • Standard Profiles: We do not currently charge a fee for talent to create a basic profile and submit an application to HouseOfIcons.

  • Changes: We reserve the right to introduce fees or charge for premium features in the future. Any such changes will be notified to you in advance.

6. Modeling Agency Disclaimer

HouseOfIcons is a digital platform and marketing tool. We provide exposure and tools to help you develop your personal brand. Use of HouseOfIcons does not create an exclusive or non-exclusive modeling agency contract. We are not responsible for negotiating contracts or managing the career of any model on the platform.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOUSEOFICONS, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.

8. Indemnification

You agree to indemnify, defend, and hold harmless HouseOfIcons and its affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any third-party right.

9. Termination

We may terminate or suspend your account and your access to the Site immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

10. Governing Law and Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
